Management liability claims
When it comes to making a claim, we recognise that this can be a stressful time for your clients and aim to resolve the problem as soon as possible, so that they can get on with their business. Here are just some of the recent claims we have handled under our management liability portfolio.
Employee accident
An employee of our insured suffered a fall whilst working at height. An investigation by the Health and Safety Executive on the activities of the client’s directors was covered under their policy.
Trading standards prosecution
Our client, a packaging company, faced 11 charges made against them by a local trading standards office. The prosecution was successful resulting in a fine of just £250. However we paid our client’s defence costs of £40,000 in addition to the costs award for the prosecution’s costs.
Employee fraud
An employee, a senior director of our insured, committed cash and credit fraud. We paid out £100,000 to settle the claim.
Unfair dismissal
Our insured dismissed an HGV driver for gross misconduct but was found to have failed to follow a fair dismissal procedure at a later employment tribunal. We settled the matter prior to a remedy hearing for £11,000.
Sex discrimination
Our client, a firm of architects, had entered into ‘without prejudice’ discussions with an employee at risk of redundancy whilst she was on maternity leave. However the employee brought a claim for unfair dismissal and sex discrimination. A preliminary tribunal hearing found that the insured could not rely on the ‘without prejudice’ discussions to defend the claim and we settled the matter before the full hearing.
